Welcome to Hi Form UK! The terms "we", "us" and "our" refer to Hi Form UK. Hi Form UK operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Hi Form UK is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights. Nothing in these Terms affects your statutory rights as a consumer under the laws of the United Kingdom, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
SECTION 1 — ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least 18 years of age, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment and shipping information. You represent and warrant that all the information you provide is correct, current and complete and that you have all rights necessary to provide this information.
You are responsible for maintaining the security of your account credentials and for activity on your account. You may not transfer, sell, assign or license your account to any other person.
SECTION 2 — OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services in our online store. Please note that colours or product appearance may differ slightly from how they appear on your screen due to your device and its settings.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer. This does not affect orders we have already accepted, and nothing in this section affects your statutory right to receive products that are as described, of satisfactory quality and fit for purpose.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. Hi Form UK reserves the right to accept or decline your order at its discretion. Your order is not accepted until Hi Form UK confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you using the email, billing address and/or phone number provided at the time the order was made, and will refund any payment taken for an order we do not fulfil.
If you are a consumer, you also have a statutory right to cancel most online orders within 14 days of receiving your goods, without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Details of how to exercise this right, and of our returns process, are set out in our Refund Policy [LINK]. Your purchases are subject to return or exchange in accordance with that policy and your statutory rights.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export. Trade and wholesale customers purchase under our separate trade terms — please contact us for details.
SECTION 4 — PRICES AND BILLING
All prices shown in our online store include VAT at the applicable rate. Delivery charges, where they apply, are shown separately at checkout before you confirm your order. Prices, discounts and promotions are subject to change without notice, but the price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email.
Prices posted in our online store may differ from prices offered in physical stores or in stores operated by third parties. We may from time to time offer promotions governed by separate terms; if there is a conflict between promotion terms and these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases, and to promptly update your account information, including your email address and payment card details, so that we can complete your transactions and contact you as needed. You represent that you are duly authorised to use the payment method you provide.
SECTION 5 — SHIPPING AND DELIVERY
Delivery times shown are estimates. We will deliver your goods without undue delay and in any event within 30 days of your order being accepted, unless a longer period is agreed with you. Where a delay is caused by an event outside our control, we will let you know as soon as possible and take reasonable steps to minimise the effect of the delay.
If you are a consumer, the goods remain at our risk until they come into your physical possession (or that of a person you have nominated to receive them). Ownership of the goods passes to you once we have received payment in full and the goods have been delivered. Our delivery rates and options are set out in our Shipping Policy [LINK].
SECTION 6 — SUBSCRIPTIONS
Where you purchase a product on subscription, you are authorising a recurring monthly payment: your chosen payment method will be charged at the confirmed subscription price on each monthly renewal date until you cancel. The key terms of your subscription — product, pouch size, price and delivery charge — are presented before you subscribe and confirmed in your subscription confirmation email.
You can cancel, pause or swap your subscription at any time, free of charge, through your online account or by emailing info@hiformequine.co.uk. To avoid being charged for the next month, cancellations must be made before 12 noon on the day before your renewal date. We will send you reminder notices where required by law, and cancelling online will always be as straightforward as subscribing was.
Your first subscription order carries the statutory 14-day cooling-off right: you may cancel at any time before delivery and up to 14 days after receiving your first order for a refund in accordance with our Refund Policy [LINK] and the Consumer Contracts Regulations 2013. Cancelling the subscription itself (to stop future deliveries and charges) is free and available at any time.
If a renewal payment fails, we will notify you and may retry the payment; if payment cannot be collected, we may pause or cancel the subscription. Subscription prices are honoured at the rate confirmed at sign-up; if we ever need to change the price of your subscription, we will give you advance notice and the opportunity to cancel before the new price takes effect.
SECTION 7 — INTELLECTUAL PROPERTY
Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement thereof, are owned by Hi Form UK, its affiliates or licensors and are protected by the intellectual property laws of the United Kingdom and other countries.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants you any licence or other rights under any intellectual property of Hi Form UK, Shopify or any third party. All rights not expressly granted are reserved.
Hi Form's names, logos, product and service names, designs and slogans are trademarks of Hi Form or its affiliates or licensors and must not be used without prior written permission. Shopify's name and marks are trademarks of Shopify. All other marks are the property of their respective owners.
SECTION 8 — OPTIONAL TOOLS
You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor control. You acknowledge and agree that we provide access to such tools "as is" and "as available" without warranties or endorsement, and that your use of them is at your own discretion. You should ensure you are familiar with the terms on which such tools are provided by the relevant third-party provider. Any new features offered through the Services shall also be subject to these Terms of Service.
SECTION 9 — THIRD-PARTY LINKS
The Services may contain materials and links to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites, and accessing them is at your own risk. Please review the third party's policies before engaging in any transaction, and direct any complaints or questions regarding third-party products to the third party.
SECTION 10 — RELATIONSHIP WITH SHOPIFY
Hi Form UK is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Hi Form UK. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Hi Form UK, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Hi Form UK, to the extent permitted by law. Nothing in this section affects your statutory rights against Hi Form UK as the seller.
SECTION 11 — PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy [LINK], and certain personal information may be subject to Shopify's privacy policy (available at shopify.com/legal/privacy/app-users). Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit may be shared with Shopify and with third parties, which may be located in countries other than where you reside, in order to provide services to you. SECTION 12 — FEEDBACK AND REVIEWS
If you submit, upload, post, email or otherwise transmit any ideas, suggestions, feedback, reviews, proposals or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including commercial use.
You represent and warrant that: (i) you own or have all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with your Feedback; and (iii) your Feedback will comply with these Terms. We are under no obligation to keep Feedback confidential, to pay compensation for it, or to respond to it.
We may, but have no obligation to, monitor, edit or remove Feedback that we determine to be unlawful, offensive, threatening, libellous, defamatory, obscene or otherwise objectionable, or that violates any party's intellectual property or these Terms. You agree your Feedback will not violate the rights of any third party, will not contain unlawful, abusive or obscene material or malware, and that you will not use a false email address or impersonate any person. You are solely responsible for the Feedback you post and its accuracy.
SECTION 13 — ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice (including after you have submitted your order). If we cancel an order for which payment has been taken, we will issue a full refund.
SECTION 14 — PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) in breach of any applicable law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, harm, defame, slander, disparage or intimidate any person; (e) to transmit false or misleading information; (f) to send or use any material that does not comply with these Terms; (g) to transmit advertising or promotional material, including junk mail, spam or similar solicitation; (h) to impersonate any person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use of the Services or which may harm Hi Form UK, Shopify or users of the Services, or expose them to liability.
In addition, you agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm or pretext the Services; (e) use any robot, spider, scraper, automated tool or AI tool to access the Services except as permitted under Section 15; or (f) interfere with or circumvent the security features of the Services. We reserve the right to suspend or terminate your account if we determine you have violated any part of these Terms.
SECTION 15 — AGENTS
This section applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, and that can be executed without direct supervision.
No Agent may access, use or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with the following requirements, and no Agent may do so where we have requested it refrain. We may limit, including by technical measures, whether and how any Agent accesses the Services. Agents must: (i) identify themselves in all HTTP/HTTPS requests by including "Agent/[agent name]" in the user agent string; (ii) not conceal or obfuscate that access is from an Agent, such as by mimicking human behaviour or completing or circumventing CAPTCHAs; (iii) respond truthfully to any prompt seeking to determine whether interactions come from a human; and (iv) not circumvent any measure intended to control Agent access to the Services.
SECTION 16 — TERMINATION
We may terminate this agreement or your access to the Services (or any part thereof) at any time, and you will remain liable for all amounts due up to and including the date of termination. Termination does not affect orders we have already accepted or your statutory rights in respect of products you have purchased.
The following sections will continue to apply following any termination: Intellectual Property, Feedback and Reviews, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.
SECTION 17 — DISCLAIMER OF WARRANTIES
The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness or usefulness of this information, and any reliance you place on it is at your own risk.
THE SERVICES (MEANING THE WEBSITE AND RELATED ONLINE FEATURES, AND NOT THE PRODUCTS YOU PURCHASE) ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.
YOUR STATUTORY RIGHTS: nothing in these Terms affects your rights as a consumer under the Consumer Rights Act 2015, under which the products you purchase must be as described, of satisfactory quality and fit for purpose, nor your rights under the Consumer Contracts Regulations 2013. If products do not conform, you may be entitled to a repair, replacement or refund. For detailed advice about your statutory rights, contact your local Citizens Advice service or Trading Standards office.
SECTION 18 — LIMITATION OF LIABILITY
NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR: (A) DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; (C) BREACH OF YOUR STATUTORY RIGHTS AS A CONSUMER; OR (D) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY LAW.
SUBJECT TO THE ABOVE: WE SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF SAVINGS, LOSS OF DATA OR ANY INDIRECT OR CONSEQUENTIAL LOSS ARISING FROM YOUR USE OF THE SERVICES; AND OUR TOTAL LIABILITY TO YOU IN CONNECTION WITH ANY ORDER SHALL NOT EXCEED THE PRICE YOU PAID FOR THE PRODUCTS GIVING RISE TO THE CLAIM. IF YOU ARE A CONSUMER, WE ARE RESPONSIBLE FOR FORESEEABLE LOSS AND DAMAGE CAUSED BY OUR BREACH OF THESE TERMS OR OUR FAILURE TO USE REASONABLE CARE AND SKILL.
SECTION 19 — INDEMNIFICATION
You agree to indemnify, defend and hold harmless Hi Form UK, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, or (2) your violation of any law or the rights of a third party. This section does not affect your statutory rights as a consumer.
SECTION 20 — SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions.
SECTION 21 — WAIVER; ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies posted by us on this site constitute the entire agreement between you and us and govern your use of the Services, superseding any prior agreements. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
SECTION 22 — ASSIGNMENT
You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign or delegate these Terms and our rights and obligations without consent, provided this does not reduce your rights under these Terms.
SECTION 23 — GOVERNING LAW
These Terms of Service, and any separate agreements whereby we provide you Services, shall be governed by and construed in accordance with the laws of England and Wales. Disputes arising in connection with these Terms shall be subject to the jurisdiction of the courts of England and Wales, save that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts, and you will retain the benefit of any mandatory consumer protections of the law of the part of the UK in which you live.
SECTION 24 — HEADINGS
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 25 — CHANGES TO TERMS OF SERVICE
You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates to our website. We will notify you of any material changes in accordance with applicable law, and such changes will be effective on the date specified in the notice. Changes will not affect orders already accepted, and your continued use of the Services following the posting of changes constitutes acceptance of those changes.
